Change to survivor benefit eligibility for common-law partners

A recent Ontario court ruling has changed the treatment of pre-retirement death benefits for common-law partners.
This ruling affects you if you are in a common-law relationship and:
- were previously married, and
- have not yet divorced.
If you meet both of these conditions, your common-law partner is currently ineligible for survivor benefits if you die before going on pension.
