Benefits Adjudication Committee

Throughout, “OTPP” refers to the corporate organization, the Ontario Teachers' Pension Plan Board, and “board members” refers to the members appointed to the OTPP.

 

Authority
The Benefits Adjudication Committee is a standing committee of the OTPP established to consider and determine appeals as provided in section 87 of Schedule 1 of the Teachers’ Pension Act.

 

Structure
The Committee shall be composed of ten members as follows: two Board Members (with preference that each of them was appointed to the OTPP by a different Partner), five persons nominated by the Ontario Teachers' Federation and three persons nominated by the Ministry of Education.

 

Responsibilities

  1. To consider appeals from the decisions of OTPP staff concerning a person’s entitlement to, or the amount of, a pension benefit.
  2. To determine all appeals in accordance with the pension plan documents including the Teachers’ Pension Act, Schedule 1 made under that Act and the Retirement Compensation Arrangement, all as amended from time to time.
  3. To advise the Appellant in writing of the Committee’s decision, stating reasons.
  4. To advise the board members of decisions of the Committee.
  5. To provide OTPP staff with comments regarding changes to administrative policies and/or practices.
  6. To provide comments regarding changes to the pension plan which impact on benefits matters and make recommendations to the board members.
  7. To advise the board members and carry out such other tasks, consistent with the above matters, as directed by the board members.

 

Position Description for Chair of Benefits Adjudication Committee
The Chair of the Committee shall:

  1. Provide leadership to enhance the Committee's effectiveness by
    1. ensuring that the areas of responsibilities of the Committee and OTPP staff are understood and respected by both; and
    2. overseeing the discharge of the Committee’s responsibilities including its reporting to the board members

  2. Act as the liaison between the Committee and OTPP staff
    1. to carry out the annual calendar of the Committee’s business;
    2. to set the agenda for each Committee meeting; and
    3. to ensure that proper information is brought to the Committee including regular reports and documentary materials in support of OTPP staff proposals
